Herman was transferred to a different county jail for causing disruptions or fighting while he was in jail. After he was transferred the first time his actions didn't change, so he was once again transferred to another county jail. Herman had been in three different jails in less than two months, by the time that he went to court he was once again transferred back to the original jail (his uncle and his cousin both worked there). The family continues to fight to get the case heard in a different county, and they eventually won. Even though it was being brought before a different judge the prosecutor was still the one from the county where the crime was heard, which didn't help the family (the decided to try to get that taken care of by going through the state). Everytime the family filed a motion it was blocked by the prosecutor, and never amounted to anything.
With Herman in jail, Billy's family is still trying to collect evidence of Herman's involvement in the murder. His uncle has gone to Billy's trailer and documented everything with a video camera, voice recorder, and a laser light to see how everything actually happened that fateful night of November 24, 2010. What he found out was that the shot that hit and killed Billy came from the passenger side of the vehicle, which is where Herman was at, instead of from the driver side like the local police said to cover for Herman. Once inside the house, Billy's uncle found evidence that both Jeremy and Herman were inside the house after Billy was shot, and made two phone calls to someone after they used a towel to check to see if Billy was dead. He found a hand towel with Billy's blood on it in the kitchen and a bath towel under his body. He also inspected the hole in the door from the inside to make sure the angle matched what had calculated from the outside. He then used a string to show the trajectory of the bullet from inside and outside, and found that they lined up perfectly to where the passenger would have been standing. He told the state police that they needed to send their investigators back to the crime scene and reanalyze the trajectory of the bullet, because they were wrong. Billy's uncle then hired an expert to come over to analyze the trajectory and all the evidence that he had found (he left everything where he found it and didn't touch anything), and the expert found that the state police were wrong. All of this evidence was then submitted to the state police and the county prosecutor, but they still refused to submit it as evidence or file charges.
The prosecutor took the statements that were given to the local police after the evidence, and didn't look at any of the evidence that was found by anyone else (state police, Billy's uncle, or the expert hired by the family).
They say that Jeremy was the one that shot and killed Billy, but it was actually Herman. The family is still outraged that Jeremy is still walking the streets, and Herman is only in jail for a DUI and neither of them are facing murder charges.
Herman's lawyer was trying to get his time cut that he would have to spend in jail using "good time", but the judge looked into where he was transferred so many times because of fighting and causing disturbances in those jails. Once that was denied his lawyer then worked on a bond reduction, once it was granted he had to go back to court to have an ankle bracelet put on to monitor his location. Herman was released from jail on bail for a thousand dollars on February 11, 2013, because the judge granted his bond reduction motion from his attorney. Herman is back in jail by July 6, 2013 for breaking the terms of his release and bail. The Judge told him that he Knowingly, Intentionally, and Willfully broke the terms of his Bond. The Judge, also, looked at Herman and said, "I gave you a chance, Mr. Gehl, I let you out so you could work, Not so you could go to the bars and do whatever you wanted to. You did this to Yourself, Mr. Gehl, No One Else, YOU"! Now Herman is in jail until his next court date of July 29th for his DUI's. Herman is already causing trouble in the jail and crying about how he isn't supposed to be back in jail. Herman's trial for his DUI's was set for this Monday (July 29, 2013) but it has been postponed until Oct. 21, 2013 at 9AM, until then he stays in jail. But, even there, he still has it better than the other prisoners. Because he has relations with other Gehl ass kissers who work there. So, just like before, he will get extra meals that the others don't get. He will, probably, get extra blankets again, so he can hang them across bars in his cell so no one can see in. (I guess for when he needs some...."Alone Time!")
Herman is going to be in court on Oct. 16, 2013 at 9am to face the charges of being a Habitual Offender. Herman has two (2) fairly recent DUI's (within the last few years) and in order for Prosecutor Minton to have three (3) offenses against Herman. Minton had to reach all the way back to 1994 for an old drug charge that Herman II pleaded guilty too. Now, Herman's lawyer says that Judge Rhodes didn't read Herman his rights during court. They say it isn't in the transcripts. Minton says that Herman plead Guilty to the charge and that it, along with the two (2) DUI's should count towards Herman being an Habitual Offender. It even sounds like a stretch to everyone. However, the last time Herman was picked up for drunk driving it took about 20 minutes to get him to the Orange Co. Sheriff's Office. Then for some reason, by law, he could wait 20 more minutes before he was to take a breathalyzer test. While waiting for time to pass the Indiana Police Officer left Herman (in Handcuffs) in another room while he went to talk to the dispatcher. When the Officer returned Herman was out of the handcuffs. The Officer asked Why Herman was let out of his handcuffs, and he was told that Herman wanted to get a drink of water. When someone is waiting at a police station or the Sheriff's station for a breathalyzer, they are NOT to eat or drink Anything. Not even to rinse their mouths out before the test is done. Anyone who has keys to handcuffs and working at the Sheriff's Office knows this. So, now that Herman has gotten a drink of water (and whatever else he needed to drink or gargle with) now he can Legally wait another 20 minutes before he has to take the test. Of course, Herman tells the Indiana State Officer that he wants to wait for 20 more minutes. So far, it has been an hour since Herman was first picked up. Herman blew over .09 when he was first stopped that night. But, by the time he Finally, took the test at the Sheriff's Office, it was .05. Whoever let him out of the handcuffs that night is a real piece of s**t! There is No doubt they are a GEHL Ass Kisser! Anyway, if the Judge doesn't go for the Habitual Offender charge Herman might be getting out of jail sooner than the family expects.
