2018 was another bad year for Billy's family, Herman was walking the streets causing trouble for the family of Billy Joe, and flaunting himself as a free man every chance he got. He would drive by Edith's home slowly, just to antagonize her, and would stop right in the middle of the road staring at her with a smile on his face. Instead of calling the police she called Billy's uncle to report it because they learned quickly that nothing would be done. She finally went and got her a gun permit and a handgun. After she did that she went straight to the prosecutor's office and informed them of what was going on, and told them that the next time she would shoot his tires out right in front of her house before she called the police. The news traveled fast to Herman and his family, soon a police officer was at Edith's house asking her about her conversation with the prosecutor's office, and Edith told them exactly what she said during the conversation. The police then asked her to put her gun down (which she was holding by the barrel), they tackled her to the ground and placed her under arrest. Edith stands around 4'7" and only weighs 90 pounds, she has chronic COPD and heart problems. She is forcefully put on the ground by grown ass men that are more than four times her size. She is charged with resisting arrest, intimidation of a police officer because they said she was pointing her gun at them, and assault on a police officer.
At the time of her arrest the police were wearing body cams and their patrol cars were facing her with their cameras running. William and Amber were also present during the incident. She was all banged up by being forced to the ground, her arm was covered in bandages, her arms were wrapped in ace bandages, and her left arm was in a sling. She had not even made it to the jail, and Billy's uncle already knew what had happened. As soon as he found out he called an attorney in New Albany to represent her against the charges. She was released on a $1500 bond which was posted by Freddy (Billy's uncle).
Instead of being able to focus on Billy's murder or healing, now the family is trying to keep Edith from going to prison because of the charges she is facing. Her attorney knew that this was a winning case because of the footage of the body cams the police were wearing along with the footage from their dash cams. She never had to call William or Amber to the stand as witnesses, but they sat there with her through the entire court process. The prosecutor tried to say that Edith did not have a handgun permit or a license to carry a concealed weapon because she never showed it to them. Her attorney told them she had seven days to provide them with a copy of her permit and license (which she did during court).
The entire time she was dealing with the charges she was facing Herman had started harassing William and Amber trying to provoke him and cause him to do something. He thought because his grandma was facing some reason time that he would make sure that would too, not thinking that Freddy had the money to get them both out or get them both attorneys (which he was sadly mistaken). Freddy had worked for a union for over 45 years, and had a good pension not to mention his wife worked for Toyota for over 30 years and had just retired. They both had a significant amount of money, and would have done anything to help Billy's mother and child. That of course never had to come to that because William just laughed in Herman's face at his stupidity, and informed him of how much money his uncle actually had. Herman still thinks he is untouchable and continues to antagonize William telling him that he could get rid of him the same way he got rid of his dad and claim self defense. By this time William and Freddy have cameras put on the property with voice recording, they are recording everything that is going on and being said. They take a copy of the tape to the prosecutor's office, and tell them that they want something done with Herman. They had all the evidence they needed to charge Herman for Billy's murder, intimidation, stalking, trespassing, and harassment. The prosecutor told them that they would review the information and would be in touch. Of course that never happened, and they did not expect it to happen.
Edith's charges all got dropped, and they got the bond money back. The judge found that she was in no fault, and that the officers used excessive force that caused substantial injuries to her arms and body. Due to the judges decision the officers were put on desk duty, and we're not allowed to have any contact with her or the family. The family took this as a small victory, and were pleased to be able to finally be able to win even a tiny victory over the police and the prosecutor.
