CHAPTER TWENTY-ONE Ben succeeds in having the injunction lifted by a federal judge, and the tape recording can now be admitted into evidence. Normally, a recording would not be admissible if the party taped did not know or give permission. To make it more risky, this was part of a private psychotherapy session, protected by doctor/patient confidentiality. However, the doctor that recorded the session was the victim of murder, and the tape could possibly be considered to have evidence of crimes committed by the recorded party and other interested parties. Therefore, the court ruled against the injunction. Ben knew the evidence could be tainted, however; Dante was working for Madalena, Marc and Ben at the same time that he acquired the tape for the Prosecution, and a conflict of interes
