The human rights of Kenyan citizens are fully guaranteed under Chapter Four of the Constitution of Kenya, 2010, collectively known as the Bill of Rights. These rights are inherent, belong to every individual, and are not granted by the State.The complete breakdown of all human rights and fundamental freedoms guaranteed to Kenyans, categorized according to the Constitution, is structured below.Civil and Political RightsRight to Life: Every person has an inherent right to life that must be protected.Equality and Freedom from Discrimination: Full equality before the law regardless of gender, race, tribe, age, disability, or religion.Human Dignity: Everyone has the right to have their dignity respected and protected.Freedom and Security of the Person: Protection against arbitrary detention, torture, violence, or cruel treatment.Freedom from Slavery: Absolute protection from slavery, servitude, or forced labor.Privacy: Protection against unauthorized searches of person, property, or private communications.Freedom of Expression: The right to speak out, seek, receive, or impart information and ideas.Freedom of the Media: Guarantee of independent press and broadcasting freedom without State control.Access to Information: Right to obtain information held by the State or another person necessary to protect rights.Freedom of Association: Right to form, join, or participate in the activities of an association of any kind.Assembly, Demonstration, Picketing, and Petition: Right to peaceably assembly and demonstrate while unarmed.Political Rights: Freedom to form political parties, participate in public affairs, and vote in free, fair elections.Freedom of Movement and Residence: Right to move freely, reside anywhere in Kenya, and access a Kenyan passport.Economic, Social, and Cultural RightsAccording to Article 43 of the Constitution, every Kenyan citizen is entitled to:Health: The highest attainable standard of health, including reproductive healthcare.Housing: Accessible and adequate housing, alongside reasonable standards of sanitation.Food: Freedom from hunger and access to adequate food of acceptable quality.Water: Clean and safe water in adequate quantities.Social Security: State-supported social protection if unable to support oneself.Education: Right to basic and progressive education.Property Rights: Protection of right to own property or land anywhere in Kenya.Labour Relations: Right to fair remuneration, reasonable working conditions, and joining trade unions.Environment: Right to a clean and healthy environment for present and future generations.Language and Culture: Right to use the language and participate in the cultural life of choice.Consumer Rights: Protection of health, safety, and economic interests when purchasing goods or services.Justice and Administrative RightsFair Administrative Action: Right to administrative processes that are expeditious, efficient, and lawful.Access to Justice: Guaranteed access to courts of law or independent tribunals.Rights of Arrested Persons: Right to remain silent, be informed promptly of the reason for arrest, and be brought to court within 24 hours.Fair Hearing: Right to a public, fair trial before an independent and impartial court.Rights of Detained Persons: Right to humane conditions, legal representation, and medical care while imprisoned.Special Protection for Vulnerable GroupsPart 3 of Chapter Four mandates extra protections to ensure the rights of specific groups are fully realized:Children: Right to a name, nationality, basic nutrition, shelter, healthcare, and protection from abuse.Persons with Disabilities: Access to public places, transport, communication, and materials tailored for their needs.Youth: Access to relevant education, training, and employment opportunities.Minorities and Marginalized Groups: Affirmative action to ensure representation in governance and access to employment.Older Members of Society: Right to live in dignity, receive reasonable care, and retire with social security.
