"It happened September 21, 2012. I was coming in from work," tears formed, "and that's when I saw him...lying there...in a pool...of his own blood." "Him who Mrs. Lomaz" "My husband...Daniel Lomaz" The lawyer watched Mrs. Lomaz body language. While his words implied that she's the killer, her body language told a different story. "What exactly happened that week before, that could have possibly led up to this devastating occurrence, Mrs. Lomaz? Tell us in your own words." She looks up, gripping the kleenex in her right hand, with tears streaming down her porclein face "OK." A few more sniffles and batting of the eyelashes to rid the tears, as her brown eyes grew, recalling the events of that day... "Well...last Saturday, on the 15 of September during the afternoon, we decided to have an impromptu party that evening. Many of our friends and family didn't have to work that day, so why not. So a few of our mutual friends came over and we played games and had a decent time," she started to reminisce. "Everyone was upset, because, of course, we kept winning. We're such a great team. There was one friend, well his friend, in particular though...she's always made me raise my eyebrow. Her words and actions are...well...flirtatious, towards my husband and we've discussed the situation before. See they used to be intimate but weren't ever officially dating, although until this day she believes they were. Moving on, that night her peculiar ways got the best of me." "Why is that Mrs. Lomaz" "She can't handle her intoxicating beverages, I suppose." "Go on..." said the lawyer in anticipation of what would be said next. "Well everyone was leaving, but she chose to stick around longer and I motioned to him to call her a cab, cause she was not staying in my home in that state. Well he followed me to the room, as she passed out on the sofa, and an argument occurred as to why I felt strongly about her not staying at our home and well he of course didn't see things that way. However he still called her a cab and she made it home. The next day we had a discussion on what makes us both feel comfortable and agreed that if a situation made us uncomfortable, that we would quickly resolve it, no questions asked. Days went by and we were so happy and our daughter was back from her fathers place by Tuesday. So things were indeed good. On Wednesday...that's when things took an odd turn." A few of the jury members started to sit up in their seats. Eyes staring holes through Mrs. Lomaz as to what would she say next. "Tell us why it took an odd turn," the persistent and stealthy lawyer asked. "Well we had an accidental phone exchange. Which was nothing new. These messages were coming in from her..." interrupted by the invasive lawyer "By who, who's "her"?" "Brooklyn-Denay Melvina Lachey." "Proceed..." "Well I ignored them at first, but then more and more came flooding in. A couple from my belated husband as we joked about having each others phones again. But 10 from her. Saying it was good seeing him last night. She hopes to have more encounters with him. She's so in love with him still. Then the messages became more...rampage like. Why didn't he text her like he used to. Just because he is married doesn't mean they couldn't be friends. Why was he ignoring her messages. And the 'you knew who I was last night,' message." "Mrs. Lomaz, did you ever suspect, at any point, that he may have been cheating on you?" Mrs. Lomaz was stunned by the question. "No! Not my husband!" "How do you know that?" *objection* *over ruled, proceed* "Because of our past, our family history. We very well know what cheating on your spouse does and we didn't ever want that act of disrespect and betrayal to ever come between us!" "Mhm, so then how did you handle the message situation? Another fight that incited you to murder?" "No! I would never kill my husband!" Mrs. Lomaz slammed her hand down on the podium & proceeded to cry and in between tears managed to say "I love him with my all, I waited for him for years just to come home, I cherished every moment together like our last." "Well it certainly was his last huh!" "You son of a b***h! How dare you!" "No further questions, I got what I needed." The officer politely escorted Mrs. Lomaz off the stand. Her lawyer consoled her as best as he could. Whispering to her that she did good and to drink some water. Brooklyn was now on the stand. How obvious it was on the jury's face that they wanted a scandal. They wanted a love triangle to manifest in order to give themselves a guilty pleasure of a murder case. Lovers quarrel, and the mistress. "My name is Brooklyn-Denay Melvina Lachey." "Since the topic is still...a heated one, why did you send those messages to Mr. Lomaz's phone? Were you two having an affair?" "Yes! Every Tuesday morning at the Midtown Bakery. He would have his hot cocoa and his "donut"..." she laughed a little so that everyone understood her metaphor to a s****l "donut." Clever yet inappropriate. "The next day I sent him messages because I always do the next day and I noticed he was reading my messages, but wasn't responding. So yes I became indignant and kept messaging him until I finally received one saying *this is his WIFE, I knew you had something for my husband, I suggest you leave him alone or there will be consequences that you won't come out of* I felt threatened like my life was in danger." Mrs. Lomaz sighs and rolls her eyes her lawyer calms her down with one look of disapproval. "I didn't know what to do...so I let things cool down for a day. Then Friday came along, and I went for a run early in the afternoon. From blocks away I heard two gunshots and in the direction of the Lomaz home. So I ran there to check on them only to find Daniel dead." Brooklyn pulls out a tissue and sobs the rest of her story. "So Ms. Lachey why didn't you call the police at that moment?" "Because I was in a state of shock and denial. Not MY Daniel" Mumbling under her breath, Mrs. Lomaz slowly becoming more agitated "her Daniel, ha." She gripped on the glass of water in order to maintain her focus on what was being said. "So after your denial Ms. Lachey, what did you do?" "Well I ran back towards my home crying. Then decided to run back and check on the scene, maybe find some evidence and call the police. But when I got there his 'wife' had just pulled up, as though nothing had happened, smiling and on the phone." Brooklyn peers over at Mrs. Lomaz "I must say, you put on a good show for the police and ambulance. But I wasn't fooled. Its YOU that killed him! He was supposed to be mine! He's my everything!" Mrs. Lomaz became so upset without words, tighten her grip so hard around the glass, that it shattered in her hands. "See! Look how she broke that glass & it didn't even phase her! The look of a killer ladies and gents" *get her off the stand* The judge demanded! *another outburst like that from either one of you ladies & you will be detained! A recess was ordered, so that Mrs. Lomaz could have her hand quickly checked out. From the looks of things, the trial was about to come to a swift ending. Back inside the courtroom, Mrs. Lomaz hand is wrapped up nicely with 3 stitches and some ice. A plastic cup was given to her. *Mrs. Lomaz, is to come to the stand again* "Quite a display you put on...how's your hand?" Asked the presumptuous lawyer with a smirk on his face. "Its perfect." "Sure. So now knowing that your late husband had a mistress...how does that make you feel?" Mrs. Lomaz slightly laughed "you all really believe the drunken w***e? Oh I see. If you listened she said she saw him in the morning but her messages said "last night"...maybe she was too drunk to realize that her morning & night were off. And on that night he was with his family! And during that morning I had made us breakfast. Steak, eggs & cheese grits. He stayed home a little bit longer that morning because after the kids went to school, WE made love. So there's no possible way he was ever with her." "Okay, so that covers Tuesday and Wednesday, but what about the other mornings or the other Tuesdays, Mrs. Lomaz? Did he go to the Midtown Bakery?" "Yes." "So how do you know he wasn't there meeting up with his mistress some mornings?" The lawyer was pressing buttons that he was not ready to handle. "Because he's not that guy! He's not my father, he's not his grandfather. I trusted him. Never once did I trust her!" "Was it because you knew they were still sleeping together, even after the 'I do's'? Or that he kept her in his life?" "They weren't still having s*x! I don't know why he kept her around because all she ever was, was toxic, complete trouble! What kind of "woman" tells a married man she's in love with him!?" Angry tears had rolled down Mrs. Lomaz porclein face, as a doll who was no longer played with by its owner. The pain in her voice and eyes sent chills down everyones spine. She proceeded..."that day, on Friday, I got off early from work and called Seasons 52 restaurant to make us reservations for our Anniversary and the owner knows, well knew him very well. And he was making sure we still enjoyed the same champagne and the same dishes prepared by him. That's who I was on the phone with while walking into our home...only to find my husband, lying there on the ground, not breathing, in a pool of his own blood. I dropped to my knees and immediately called the police, and I held his body. I'm almost sure I felt his heart beat, but once the police arrived, they had pulled me off of him. And I screamed and cried. They put him on the gurney after I screamed his heart was still beating. And then they took him." Tears poured out of Mrs. Lomaz's eyes. Your heart couldn't help but to feel faint from hearing her side. But was it all just a means of getting the jury on her side? "No! You took him from me!" Exclaimed Brooklyn. The look upon Mrs. Lomaz face will be forever etched upon everyones mind. If eyes were guns, then that look would have shot through the very existence of Ms. Lachey. No tears fell after that...only scorn. Only the look of devastation that another woman had the audacity to continue to claim her husband and really believe they still had something going on behind her back. "Are you done asking questions?" An impatient Mrs. Lomaz grew more weary. "Yes. Unless there's anything further that you would like to say, then I have no further questions left." As Mrs. Lomaz started to descend from the chair...the courtroom doors had opened. Could this really be happening? Were their eyes being deceived? Mr. Daniel Lomaz had came into the courtroom, in a wheelchair..."No, but I have something to say!" Mrs. Lomaz face had filled with joy, like a child at the zoo watching the lion roar for the first time. Brooklyn-Denay though, did not look too thrilled to watch as Daniel rolled his way towards his wife immediately. Embracing her very soul as he hugged her and they cried together. "I thought you were dead..." cried Mrs. Lomaz "You were the only one who felt my heart still beating, once again you saved my life." Brooklyn then stood up and snatched a gun out of the officers holder and started to shoot towards the Lomaz's. "You should've been dead you asshole!!" The whole courtroom screeched with chilling screams and cries, even trampled over one another to get out. The officer swiftly tackled Brooklyn down to the wooden floor and handcuffed her. But everyone still wanted to know..what exactly happened. "You took him from me! That should be YOU in that wheelchair or in hell by now! I should've taken him from you, so that you could feel the pain that I go through every single day! I will have him!" Brooklyn was in rage while handcuffed. But even in her fury there wasn't a real confession. *Mr. Daniel Lomaz takes the stand* "Mr. Lomaz, can you recall anything from that dreadful day?? We all thought you were dead!" Said the confused lawyer. "I was dead..." a softly spoken, bruised Mr. Lomaz exclaimed..."but I fought it out! I knew I had a family to go home to that needed me. I had gotten off of work early that day and was preparing lunch for my wife Patricia, for our anniversary. And had plans on taking it to her job. I saw someone in my peripheral, a woman, with a hoodie on & what appeared to be running clothes. After that all I remember is seeing my own blood & my wife's crying face and I again blacked out." The jury all shook their heads in unison. Mr. Lomaz continued..."I did however manage to pull this necklace from around their necks...the same necklace I gave to my wife on our first date." The jury was shook up by this news! Had this gentle woman played with the minds of the court?! Were those tears even real?! Mrs. Lomaz didn't budge at all. "So it was your wife that attempted to kill you Mr. Lomaz??" Shouted the lawyer in excitement as though the smell of victory had already embraced his nose. "No..." said Mr. Lomaz..."I sat in the hospital crying my eyes out thinking why would my wife do such a thing. But then I looked, and there was an inscription that said 'Daniel and Brooklyn forever' on the necklace. I have the necklace right here with me!" The courtroom became restless with murmuring. "She had created an exact replica of my wife's necklace, but made the rookie mistake of having her own name engraved," stated Daniel. An infuriated Brooklyn shouted "you should've been mine! You should be dead by now! You and her!! I could have easily gotten away with it! I deserve him not you! I thought it was you!! I've been tracking your every move and I knew that if I got the chance I could get rid of you! Instead my poor Daniel was in the way!! So I had to do it! I wasn't leaving until I saw someones blood on the ground! Daniel I love you! You have to believe me! I did this for us!! Tell her you love me! Tell her you call me baby still! Tell her!" "I didn't. Maybe in the past when we fooled around, but I wouldn't dare do that to my wife! She waited on me for years and you played around. Why would I want used goods! Those times you messaged me and called me you know I didn't respond. Yeah YOU called me baby...why would I allow myself to say those things back to you and disrespect my wife and family. I told you to stop calling me those things and stop attempting to come between us long time ago but you wouldn't. I blocked you and you found me, exclaimed that you changed. And I felt bad for you. That's the only reason we allowed you in as merely an associate, if that! But now that I look at things, you were all about your own personal gain! I bet you wouldn't look at me twice in this wheelchair that YOU put me in! You don't love me...but my wife does." The jury left after the moving speech from Mr. Lomaz, to deliberate. ... *we find Brooklyn-Denay Melvina Lachey guilty on all accounts* *we find Patricia Lomaz not guilty on any charges against her* Brooklyn ran towards Mr. Lomaz but before she could get there Mrs. Lomaz had laid her out flat with one punch to the throat. ¤
